KairoFlex Terms of Use
Last updated 26 October 2026
1. Who we are and how to reach us
KairoFlex is provided by KairoFit LLP (LLP Identification No. ADA-1569), a limited liability partnership registered in India with its registered office at Greenland Park Apartment, Narendrapur, South 24 Parganas – 700103, West Bengal, India. In these Terms "KairoFit LLP", "we", "us" and "our" mean KairoFit LLP; "KairoFlex" or "the app" means the KairoFlex mobile app for iOS and Android and the services behind it; "KairoFit" means the gym-management software we provide to gyms; and "you" means the person who creates a KairoFlex account.
For help using the app, use kairofit.in/support or write to support@kairofit.in. For questions about your data, legal notices and complaints, write to contact@kairofit.in. Our Grievance Officer is:
- Jeet Adhikari, Designated Partner, KairoFit LLP
- Email: contact@kairofit.in
- Address: Greenland Park Apartment, Narendrapur, South 24 Parganas – 700103, West Bengal, India
We acknowledge every complaint within 48 hours, resolve complaints about content, another user's conduct or the way the app works within 15 days, and answer requests about your personal data (a summary of what we hold, a correction, erasure, withdrawing consent, a nomination) within 30 days. Always quote the mobile number registered on your account and, if you are a gym member, the name of your gym. Section 20 and the KairoFlex Privacy Policy explain your data rights.
2. Who can use KairoFlex
- You must be 18 or older. By creating an account you confirm that you are at least 18 and competent to contract under Indian law. An agreement with a minor is void under the Indian Contract Act, 1872, and the Digital Personal Data Protection Act, 2023 allows a child's personal data to be processed only with verifiable parental consent, which we do not offer. We do not knowingly process the personal data of anyone under 18; if we learn that we have, we delete it.
- Gym members under 18 must not use KairoFlex. A gym that uses KairoFit may record a member under 18 with a parent's or guardian's consent, which the gym obtains. That consent covers the gym's records, not a KairoFlex account; the gym serves such members at its front desk.
- One person, one account, keyed to one Indian mobile number. Do not create an account for someone else, use someone else's number or hold more than one account.
- You must not use KairoFlex if Indian law prohibits you from doing so, or if we previously closed your account for breaching these Terms.
3. Accepting these Terms
You accept these Terms by ticking the acceptance box when you create your KairoFlex account. That tick forms an electronic contract, which the Information Technology Act, 2000 recognises as valid; no paper or signature is needed. Downloading the app does not by itself bind you — creating an account does.
We keep a record of your acceptance: the version accepted, the date and time, and the mobile number verified at that moment. It is kept for the life of your account plus 3 years — in a minimal, access-restricted form after deletion — as evidence of this contract, and both of us may rely on it as the record of this contract. The current version is always at kairofit.in/kairoflex/terms; earlier versions are available from us on request. These Terms are version 1, effective 26 October 2026. If you created your account before that date, we will ask you to accept these Terms before you continue using the app; you may delete your account instead (Section 13).
These Terms work together with the KairoFlex Privacy Policy, which forms part of your agreement with us, and — if you are a member of a gym that uses KairoFit — the Member Data Notice, which explains what your gym records about you. These Terms and the Privacy Policy together are also the rules and regulations, privacy policy and user agreement that the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 require us to publish.
4. What KairoFlex is
KairoFlex is free. There are no advertisements and nothing to buy inside it. It has two parts:
- A calorie and macro tracker for anyone. You choose a goal, enter a few body details, receive a suggested daily calorie and macro target, and log what you eat from our food catalogue or from foods you add yourself. Your diary, goals and custom foods are private to you.
- Gym features for members of gyms that use KairoFit. If such a gym has registered your mobile number, KairoFlex also shows your membership (plan name, dates and status), lets you check in by scanning your gym's QR code, and shows your attendance streaks, awards and your gym's leaderboards. Dues, payments, receipts and invoices are not shown in KairoFlex; those stay at your gym's front desk.
Your gym is your membership provider, not us. Your membership contract is with your gym, which sets your plan, price, dates and pauses, decides whether you are an active member, records your attendance and is responsible for its records. We provide your gym with the KairoFit software and show you, in KairoFlex, the information your gym holds about you (Section 7). We are not a party to your membership, we collect no membership fees and we cannot change your gym's decisions.
Paid features. KairoFlex has no paid features today. If we ever introduce any, we will tell you in advance, publish separate terms and prices for them, and never charge you, start a trial or move you onto a paid plan without your clear and separate agreement.
5. Your account and signing in
- Your mobile number is your login. You sign up and sign in with an Indian mobile number and a one-time code sent to it by SMS. If a gym that uses KairoFit has already registered that number, the same number opens the same account and your membership appears (Section 7).
- Google or Apple sign-in, where offered, only pre-fills your name and email; you still verify your mobile number with a one-time code. We do not store your Google or Apple user identifier, and you can use KairoFlex without either.
- Keep your number reachable. One-time codes and security notices go to your registered mobile number. If you lose access to it, tell us at contact@kairofit.in so that we can verify you another way.
- Keep your codes to yourself. Never share a one-time code with anyone, including someone claiming to be from KairoFit. We treat anything done with your code as done by you. Keep your phone locked, and tell us immediately if you think someone else has used your account.
- Accurate details. Give us true and current details. Your name, number and email cannot be changed inside the app today: a gym member asks the gym to correct name and email at the front desk; anyone can email us (Section 20).
- You may sign in on more than one device; signing out on a device ends that device's session.
6. Health information: what KairoFlex is and is not
Please read this section carefully.
- KairoFlex is a general wellness tool. It helps you record what you eat and compare it with a target you choose. It is not a medical device, and it does not diagnose, treat, cure or prevent any disease or medical condition.
- KairoFlex does not give medical, dietary or nutritional advice. Nothing in the app — a suggested target, a "green day", a streak, a food value — is advice about your health or a substitute for a doctor, dietitian or other qualified professional who knows your circumstances.
- Targets are estimates. The suggested calorie target is calculated with the Mifflin–St Jeor formula from the age, height, weight, activity level and goal you enter; the macro split comes from a preset you pick. It is a general formula, not a personal assessment. You can change the target, and you are responsible for the target you choose.
- Food values are estimates. Catalogue figures are drawn from published Indian food-composition sources and typical recipes; the food in front of you may differ, sometimes widely (India's food-labelling rules themselves tolerate a variation of up to 25 per cent in declared values). Figures for foods you add are whatever you entered. Do not rely on the catalogue for allergen, ingredient or medical decisions.
- Talk to a doctor first before changing your diet or exercise, especially if you are pregnant or breastfeeding, under medical care, taking medication, living with diabetes or another condition, or have a history of disordered eating. Anyone under 18 must not use KairoFlex at all (Section 2).
- Not for eating-disorder management. KairoFlex is not designed for, and must not be used to manage, an eating disorder or any condition under medical treatment. If tracking food or restricting calories is harming you, please stop and seek help; Tele-MANAS (14416), the Government of India's mental-health helpline, is free and open around the clock.
- You remain responsible for your own health decisions. Nothing in this section limits liability that cannot be limited by law (Section 15).
7. Gym-linked data
This section applies if a gym that uses KairoFit has registered your mobile number.
- Your gym is the Data Fiduciary for your membership data. Under the Digital Personal Data Protection Act, 2023 the "Data Fiduciary" is the person who decides why and how your personal data is used. For your membership, plan, payments, attendance, pauses, consents and the profile your gym recorded (including any photo, address, date of birth, gender or health notes), that is your gym. KairoFit LLP processes that data on your gym's instructions, as its Data Processor, and shows it to you in KairoFlex on your gym's behalf. The Member Data Notice explains what a gym records and why.
- Linking is automatic and by phone number. KairoFit keeps one record per person, keyed to the mobile number. When a gym registers your number — you confirm this at the front desk by reading out a one-time code sent to your phone — that membership appears in your KairoFlex account, whether you created the account before or after. There is no separate confirmation step inside the app today.
- A QR check-in is an attendance record in your gym's account. Scanning your gym's QR code in KairoFlex creates an attendance record in your gym's KairoFit account, exactly as if the front desk had checked you in, and your gym's staff can see it. A check-in is refused if your membership is paused or expired, or while your gym's own KairoFit subscription has lapsed; only your gym can override an expired membership, and only a payment by your gym lifts a lapse.
- What your gym sees: only its own records — the profile fields it entered (name, phone, email, address, photo), your plan and payments, your attendance (including QR check-ins, which are marked as made from the app), pauses and the consents it recorded.
- What your gym never sees: your food diary, goals, body details (age, height, weight, activity level and targets), custom foods and weekly attendance goal. No part of KairoFit shows these to any gym.
- Corrections go to your gym. Ask your gym to correct your membership, profile or attendance. If you write to us instead, we will pass your request to your gym and tell you.
- Accuracy is your gym's responsibility. We show what your gym records. We are not responsible for a wrong plan date, a missed or mistaken check-in, an archived membership or any other error in your gym's records, and we cannot change them on your instruction alone.
- If your gym archives you, or stops using KairoFit, your KairoFlex account, diary and goals are unaffected and the app keeps working as a calorie tracker. That gym's card, QR check-in, streaks and leaderboards stop, and its records stay with the gym under its own retention rules.
- One account can be linked to more than one gym: your diary and goals are shared across all of them; attendance, streaks and leaderboards are separate for each.
8. Leaderboards
If you have a live membership at a gym that uses KairoFit and have signed in to KairoFlex at least once, you are included in that gym's leaderboards (overall, most consistent, most improved and early birds, by month and by year). Other KairoFlex users who are members of the same gym can see your first name, your attendance-based score and rank and — if your gym uploaded one — your profile photo. They never see your surname, phone number, plan, dues, body details or diary; members of other gyms see nothing.
There is no switch in the app to leave the leaderboards yet. To be removed, email contact@kairofit.in with the subject "Leaderboard opt-out", your registered mobile number and your gym's name; we will remove you and confirm within 30 days. No one under 18 may use KairoFlex, so no child should appear; if you see one, tell us. If a name or photo on a leaderboard is offensive or is not the person it claims to be, report it to contact@kairofit.in; we will act within 15 days, and within 24 hours where the content is sexual in nature or impersonates someone.
9. Your content and acceptable use
Your content. Your diary entries, custom foods, goals and the name you give us are yours. Custom foods are private; nothing you add to the catalogue is shown to other users. So that we can run KairoFlex, you give us a licence to store, copy, process and display your content to you and — for your first name and any photo your gym uploaded — to members of the same gym in leaderboards (Section 8). The licence ends when the content or your account is deleted, apart from the retention described in the Privacy Policy.
Rules. You must not use KairoFlex to create, store or share anything that:
- belongs to another person and which you have no right to use;
- is obscene, pornographic, paedophilic, invades another person's privacy (including bodily privacy), insults or harasses anyone on the basis of gender, is racially or ethnically objectionable, relates to money laundering, or promotes enmity, hatred or violence;
- is harmful to a child;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads about its origin, or knowingly communicates false or misleading information;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries or public order, incites an offence, or insults another nation;
- contains a virus, malware or any code designed to interrupt, damage or limit a computer system;
- relates to an online game that is not permitted under Indian law, or advertises one; or
- breaks any law in force.
You must also not: use another person's account or number; try to get around sign-in, rate limits or other security; probe, scan or test the vulnerability of KairoFlex without our written consent; scrape or bulk-download the food catalogue or other users' data; or use KairoFlex to build a competing product (Section 11 covers reverse engineering). Publishing sexually explicit material, or material showing children in a sexual act, is a criminal offence under the Information Technology Act, 2000.
What we may do. If we reasonably believe you have broken these rules, we may remove the content, restrict features, suspend your account or close it (Section 13). Where we can, we will tell you what we did and why, and you may raise it with the Grievance Officer. We also remove content when a court or government authority lawfully requires it. We will remind you of these rules at least once a year and whenever they change.
10. Messages we send you
- One-time codes by SMS. Every sign-in, and every change that needs verification, is confirmed by a one-time code sent to your registered mobile number through our SMS provider, MSG91, under the sender and template registration that TRAI's rules (the DLT framework) require. They are service messages, sent only when you ask for one, and cannot be switched off while your account exists because there is no other way to sign in.
- Nothing else today. KairoFlex sends no marketing, no reminders, no push notifications and no email. The "WhatsApp updates" and "Email notifications" switches in the app's Permissions screen record a preference that nothing uses yet.
- If that ever changes, promotional messages will go only to people who have separately and expressly opted in, never as a condition of these Terms, and every such message will carry a one-step unsubscribe. Notices about security, these Terms or the Privacy Policy are service messages, not marketing.
11. Intellectual property
- Ours. KairoFlex, the KairoFit software, our food catalogue (its structure, names, aliases, serving units and values), our designs and logos, and the names "KairoFit" and "KairoFlex" belong to KairoFit LLP or our licensors and are protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and other laws. You receive a limited, personal, non-exclusive, non-transferable, revocable right to install and use the app on devices you own or control, for personal and non-commercial use, under these Terms. Nothing else is granted.
- Restrictions. You must not copy, modify, distribute, sell, rent or sub-license the app or the catalogue, remove any notice from them, or reverse engineer, decompile or disassemble the app — except to the extent the Copyright Act, 1957 (section 52(1)(ab) and (ac)) expressly allows despite this restriction, to obtain information essential for interoperability or to study how the program works, and then only after you have asked us for that information at contact@kairofit.in and we have not provided it within a reasonable time.
- Yours. You own your diary, goals and custom foods; we claim no rights in them beyond the licence in Section 9.
- Feedback. Ideas or suggestions you send us may be used under a perpetual, royalty-free licence without any obligation to you.
- Open source. The app includes open-source components governed by their own licences.
12. Availability and changes to KairoFlex
KairoFlex is a free, early-stage app run by a small team. We try to keep it available, but we make no promise of uninterrupted or error-free service and offer no service-level commitment. The app depends on your device, your internet connection, your gym's records, our hosting providers and SMS delivery, none of which we fully control. We may take the app down for maintenance and may add, change or remove features.
If we decide to discontinue KairoFlex, or to remove a core feature such as the food diary, we will give you at least 30 days' notice to your registered mobile number or email and tell you how to get a copy of your diary and goals first. There is no export button in the app today: you ask for a copy by email and we send it within 30 days.
13. Ending your account
- By you. You can ask us to delete your account at any time. There is no delete button in the app yet; you ask by email, and the steps, what is deleted and what your gym keeps are at Delete your KairoFlex account. We complete a verified request within 30 days, and will update that page when in-app deletion is available.
- By us, for a stated reason. We may suspend or close your account, with notice to your registered number or email where practicable, if: you are under 18 or otherwise breach Section 2; you breach Section 9 or another important term; we reasonably believe your account is being used fraudulently, to attack our systems or to harm other users; a court or authority requires it; or you have not signed in for 24 months and have not responded to a notice sent to your registered number or email. We will tell you the reason, and you may raise it with the Grievance Officer.
- By us, otherwise. In any other case we close accounts only on at least 30 days' notice — for example if we discontinue KairoFlex (Section 12). We never close an account for no reason and without notice.
- What happens next. Your access ends and your KairoFlex data is deleted as the Privacy Policy describes; only the minimal consent, acceptance and deletion records it lists are kept. Records your gym holds as its own — membership, attendance, receipts and GST documents — stay with your gym; closing your KairoFlex account does not end your gym membership, and your gym can still serve you at the front desk.
- What survives. Sections 6, 7 (accuracy of your gym's records), 11, 14 to 18 and 23, and any other term that by its nature should continue, remain in force after your account ends.
14. Warranties
We will provide KairoFlex with reasonable skill and care. Beyond that, and to the extent Indian law allows, KairoFlex is provided "as is" and "as available", without any other warranty, express or implied — including that it will meet your needs, be accurate, be uninterrupted or free of errors, or that any target or food value is correct. Nothing in these Terms affects any right you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded or limited by agreement.
15. Our liability
- To the extent Indian law allows, our total liability to you arising out of or in connection with KairoFlex or these Terms — in contract, tort (including negligence), breach of statutory duty or otherwise — is limited to ₹5,000 in aggregate.
- To the same extent, we are not liable for indirect or consequential loss, loss of profit, income, business, goodwill or anticipated savings, or loss caused by your gym's records, your device, your internet or telecom provider, or an event beyond our reasonable control (Section 17).
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; wilful misconduct or gross negligence; or any liability that cannot be excluded or limited under Indian law, including under the Consumer Protection Act, 2019, section 43A of the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
- Every limit in this section applies only so far as the law permits and does not affect the remedies a consumer commission may award.
16. Your responsibility to us
We do not ask you for a general indemnity. You are responsible for loss we suffer, and for claims that third parties bring against us, that are caused by your unlawful use of KairoFlex or your breach of Section 9 — for example content you upload that infringes someone's rights, or an attack on our systems from your account. That responsibility covers only loss that is a direct and foreseeable result of what you did.
17. Events beyond our control
We are not responsible for a failure or delay in providing KairoFlex caused by events beyond our reasonable control, including acts of God, epidemic, fire, flood, government order, war, riot, strike (other than by our own staff), and failure or interruption of the internet, telecom networks, SMS gateways, cloud hosting, app stores or electricity. We will do what we reasonably can to restore the service. If such an event continues for more than 60 days, either of us may end this agreement by notice to the other.
18. Disputes, governing law and courts
- Talk to us first. If you have a problem, write to contact@kairofit.in or the Grievance Officer and we will try to resolve it with you within 30 days. We encourage this step, but it is not a condition of anything: you may go to a court or a consumer commission at any time.
- No arbitration. These Terms do not require you to arbitrate any dispute, and nothing in them prevents you from approaching a consumer commission or any other forum the law gives you.
- Law. These Terms, and any non-contractual obligation arising out of them, are governed by the laws of India.
- Courts. Subject to your right to approach the consumer commission that has jurisdiction under the Consumer Protection Act, 2019 (including where you live or work) and any other forum a law gives you, the courts at Kolkata, West Bengal have jurisdiction over disputes arising out of these Terms. Nothing in these Terms shortens any limitation period Indian law gives you.
19. Changes to these Terms
- Material changes — anything affecting your rights, our liability, what KairoFlex costs, how disputes are resolved or what we do with your data — take effect no sooner than 30 days after we notify you by SMS to your registered number or by email, and only after you accept the new version. If you do not wish to accept it, you may delete your account before the change takes effect; the old version applies until then.
- Minor changes — clarifications, new features, corrections — are posted at kairofit.in/kairoflex/terms with an updated date and take effect 15 days after posting.
- Changes never apply retroactively. Each version carries its number and effective date; earlier versions are available on request.
20. Your data rights, nomination and duties
- The Privacy Policy explains your rights under the Digital Personal Data Protection Act, 2023 and the rules in force today — to know what data we hold, to have it corrected or erased, to withdraw consent, to complain, and to nominate someone to act for you — and how to exercise them by email, quoting your registered mobile number, with our answer within 30 days.
- Nominating someone. You may name one adult to exercise your data rights if you die or become unable to act. Email contact@kairofit.in with your registered mobile number and the nominee's name and mobile number; change or cancel the nomination the same way. We verify the nominee's identity before acting on their instructions.
- Your duties. The Act also places duties on you, which these Terms mirror: give us true information; do not impersonate anyone; do not hide facts we need to identify you; when asking for a correction or erasure, give only information you can verify; and do not file false or frivolous complaints (the Act allows a penalty of up to ₹10,000 on a person who does).
21. Accessibility
We want KairoFlex to be usable by everyone. If a disability makes any part of the app hard to use, email contact@kairofit.in; we will help you use the feature another way and treat your message as a request to fix it.
22. Additional terms for the iOS app
If you downloaded KairoFlex from Apple's App Store, these terms also apply, as Apple requires:
- Agreement with us, not Apple. These Terms are between you and KairoFit LLP only, not Apple Inc. or its subsidiaries ("Apple"). KairoFit LLP, not Apple, is solely responsible for KairoFlex and its content.
- Licence. Your licence to use the iOS app is limited to a non-transferable licence to use it on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. KairoFit LLP is solely responsible for any maintenance and support of the app. Apple has no obligation to provide any.
- Warranty. KairoFit LLP is solely responsible for any product warranty, express or implied, to the extent not disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claim, loss, liability, damage, cost or expense attributable to the failure is KairoFit LLP's responsibility.
- Product claims. KairoFit LLP, not Apple, is responsible for addressing any claim by you or a third party relating to the app or your use of it, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy or similar laws.
- Intellectual property. If a third party claims that the app or your use of it infringes its intellectual-property rights, KairoFit LLP, not Apple, is solely responsible for investigating, defending, settling and discharging the claim.
- Legal compliance. You represent that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
- Contact. Questions, complaints and claims about the app go to KairoFit LLP at the email and address in Section 1.
- Third-party terms. You must comply with any third-party terms that apply when you use the app, such as your mobile data provider's terms.
- Apple as beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you as such.
If you downloaded KairoFlex from Google Play, Google's terms of service for Google Play also apply to your download and use of the app.
23. General
- Notices. We send notices to your registered mobile number or the email on your account; a notice is treated as received the day after it is sent. Notices to us go to contact@kairofit.in or our registered office; legal notices must be in writing.
- Assignment. You may not transfer your account or this agreement. We may transfer this agreement to a successor to the KairoFlex business (for example on a merger or sale) by giving you notice; the successor is bound by these Terms and the Privacy Policy, and you may delete your account if you do not wish to continue.
- Severability. If any part of these Terms is held invalid or unenforceable, the rest continues to apply, and that part is read as narrowly as needed to make it enforceable.
- Waiver. Not enforcing a term on one occasion does not stop us enforcing it later.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about KairoFlex and replace any earlier terms for it. Nothing in them limits or excludes liability for fraud or fraudulent misrepresentation.
- Language. These Terms are in English; if we publish a translation, the English text governs.
- Relationship. Nothing in these Terms creates a partnership, agency or employment relationship between you and us.
- Third parties. Except for Apple as stated in Section 22, no one other than you and KairoFit LLP has rights under these Terms. Your gym's rights and duties towards you come from your membership contract with it, and you have no rights against us under our contract with your gym.
